Steve Bliss:
Certainly. A crucial step in most estates is what we call “Marshaling the Estate Assets.” This involves meticulously identifying and inventorying all assets belonging to the deceased individual.
It’s like piecing together a financial puzzle. We need to locate bank accounts, real estate holdings, investments, vehicles, personal property—everything of value. Ordinarily, we work closely with the executor or administrator appointed by the court to gather this information.
We then prepare detailed documentation known as an Inventory and Appraisal (Forms DE-160/161). These forms list each asset, its estimated value, and any outstanding debts or liens associated with it. This comprehensive inventory is submitted to the court for review and approval.
Accuracy is paramount during this step. Mistakes can lead to delays and complicate the distribution of assets later on. For example, once I represented a family where a valuable piece of artwork was overlooked in the initial inventory.
Discovering this omission months into the probate process required us to file amendments with the court, delaying the final distribution to the heirs. It highlighted how crucial a thorough and methodical approach is when marshaling assets.

That’s a great illustration of why this step is so important. Have you encountered any other challenges in this phase?

Occasionally, we encounter situations where locating all assets proves difficult. A deceased individual may have had complex financial arrangements or held assets in multiple states.
