“Certainly! One crucial step in probate is what we call ‘marshaling the estate assets.’ This essentially involves identifying and inventorying all of the deceased person’s assets. It sounds straightforward, but it can be quite complex depending on the individual’s financial situation.
For instance, we need to locate bank accounts, investment portfolios, real estate holdings, vehicles, personal belongings of value – you name it! Consequently, this often involves contacting various institutions and individuals. Once we have a complete list, we meticulously appraise each asset to determine its current market value.
This information is then compiled into a formal document called the ‘Inventory and Appraisal,’ which must be filed with the court. This step is vital for ensuring transparency and accountability throughout the probate process. Moreover, it provides a clear picture of the estate’s overall worth, which is essential for distributing assets according to the will or state intestacy laws.”
“There have been instances where this stage proved particularly challenging. I recall one case where the deceased had numerous investment accounts scattered across different brokerage firms. Tracking down all of these accounts and obtaining the necessary documentation took considerable effort. Notwithstanding, we were ultimately successful in compiling a comprehensive inventory. This experience underscored the importance of meticulous record-keeping and the need for families to have open conversations about financial matters.”
