Assets held within a trust bypass probate entirely, saving your loved ones significant hassle and expense during an already difficult time.
Moreover, trusts offer enhanced privacy. Unlike wills which become public record, the terms of a trust remain confidential. This is particularly important for individuals who value discretion or have complex family situations.
Trusts also allow for greater control over asset distribution. You can specify exactly how and when your beneficiaries receive their inheritances, even setting conditions like age requirements or educational milestones. This ensures your wishes are carried out and that your assets are used responsibly.

Steve Bliss:
The most common type of trust I create for clients is a Revocable Living Trust.
This type of trust offers flexibility because you retain control over the assets during your lifetime and can make changes as needed. It allows you to manage your finances, buy or sell property, and even dissolve the trust if circumstances change.
However, upon your passing, the trust becomes irrevocable, ensuring a smooth transfer of assets to your beneficiaries according to your predetermined instructions.
Ordinarily, I guide clients through the process of identifying their goals and concerns to determine the best type of trust for their individual circumstances.

I understand there are nuances to setting up a trust effectively. Have you encountered any common challenges or pitfalls that people should be aware of?
Steve Bliss:
Yes, one challenge I often see is people procrastinating on estate planning. It’s easy to put off these important decisions, but delaying can have significant consequences for your loved ones.
I remember a case where a gentleman passed away unexpectedly without a trust in place. His family was left scrambling to navigate probate, which created stress and financial burden during an already emotionally challenging time. Had he established a trust beforehand, the process would have been much smoother for them.
Another common issue is not properly funding the trust. Simply creating the legal document isn’t enough; you need to transfer ownership of your assets into the trust. Without proper funding, the trust won’t serve its intended purpose and could be rendered ineffective.
